Alabama Deceptive Trade Practices Act

The Alabama Deceptive Trade Practices Act is a state law that protects consumers from fraudulent business practices.  This law can apply to everything an Alabama resident purchases ranging from a large purchase like a home to the purchase of a vehicle or a consumer appliance or service.

While the law covers a number of different deceptive business practices, generally it provides consumers a way to pursue damages against companies who make false statements in advertising or in the quality of the goods or services they provide.  The law helps turn the tables in favor of the consumer by providing for punitive damages (up to three times the amount of loss suffered) and the recovery of attorney’s fees.

Our firm represents purchasers of new homes throughout Alabama as well as other types of consumers with claims under the Alabama Deceptive Trade Practices Act.  These claims have unique statutory requirements that differ from traditional lawsuits and it is a very good idea to consult with an attorney before pursuing your claim.  If you believe you may have a claim, please contact us at (205) 588-0699 for a free consultation.
